Maryland Will Age Requirements

Age Requirements: Any person may make a will if the person is 18 years of age or older, and legally competent to make a will. 1

Maryland Will Signing Requirements

Will Signing Requirements: The will must be signed by the testator, or by some other person for the testator, in the testator’s physical presence and by the testator’s express direction; and attested and signed by two or more credible witnesses.

Revoking A Maryland Will

A Maryland will can be revoked by executing a subsequent will that revokes it, or by burning, cancelling, tearing, or obliterating the will. Maryland code also provides that the will is automatically revoked if the testator gets married followed by the birth, adoption, or legitimation of a child by the testator provided the child or the child’s descendant survives the testator. If the testator gets divorced, all mention of the ex-spouse in the will is automatically revoked unless otherwise mentioned in the will. 2
