Age Requirements: Any person of sound mind annd 18 years of ange or over, may make an will. (North Carolina General Statutes 31-1)

Types of North Carolina Wills

North Carolina recognizes three types of wills – attested (witnessed), holographic (not witnessed), and nuncupative. All three types of wills are valid as long as the requirements are met.

North Carolina Attested Will Signing Requirements

Will Signing Requirements: The will shall be in writing by the testator or by someone else, in the testator’s name, in the testator’s presence and by the testator’s direction.

North Carolina Attested Will Witness Requirements

Will Witnessing Requirements: An attested will shall be attested (signed) by at least two competent witness, in the presences of hat testator but don’T need to sign in the presence of each other. (North Carolina General Statutes 31-3.3)
